Certificate of Habitability (Cédula de habitabilidad)

In addition to the energy certificate, another document is very important in Spain. This is the so-called Certificate of Habitability (Cédula de habitabilidad). This document certifies that a property is fit for habitation. It documents that the property meets certain minimum requirements. These include a certain size, sanitary facilities and basic technical equipment. It is required, for example, when first applying for an electricity and/or water supply. The cédula is valid for 10 years. It must then be renewed. It is a good idea to have a valid cédula for the notarisation of a property sale, but this is not compulsory.

What types of Certificate of Habitability are there?

  1. Initial certificate: Cédula de habitabilidad de primera ocupación
    This cédula is issued for a new building. This type of certificate must also be applied for if the use of the property is to be changed or if a major alteration or extension is planned. The building permit must be presented. The document will only be issued after the final building inspection (Certificado final de obra) has been carried out by the relevant municipality in Mallorca. In addition, the municipal certificate of completion (Certificación municipal de finalización de obra, CFO) is required.
  2. Follow-up certificates: Cédula de habitabilidad de renovación
    If the cédula has expired, a new application must be made for a certificate of habitability. The application must be accompanied by recent photographs of the property. An architect must also certify in writing that no changes have been made to the property.
  3. For properties before 1987: Cédula de habitabilidad por carencia
    There is a simplified application procedure for properties built before 1 March 1987 that have never been issued with a Certificate of Habitability in Mallorca. However, a ‘Certificado de situación urbanística’ from the municipality is required. This document proves that the property was built before the cut-off date of 1 March 1987, that no structural alterations have been made since then and that no proceedings have been initiated against the previous owners for building offences.

4. Renewal of an existing certificate in rural areas (Rústico)
– Copy of the purchase deed or extract from the land register (nota simple)
– Copy of the last electricity or water bill
