Terms and Conditions
General Terms and Conditions (GTC)
1. General
The following service and payment terms apply to all orders placed via this website with TODO MALLORCA CB, CIF: ESE56921356, hereinafter referred to as “¡TODO! Mallorca”. Other terms and conditions shall not become part of the contract, even if we do not expressly object to them. Deviating agreements shall only apply if confirmed by us in writing.
2. Contractual Partner, Conclusion of Contract
Your service contract is concluded with ¡TODO! Mallorca. You may commission our services by completing the online form, or by contacting us by telephone or email. By clicking the order button, you submit a binding order. Confirmation of receipt of your order will be sent by email after submission.
As part of our services, we review the submitted forms for formal completeness in accordance with the requirements of the competent Spanish authority. The decision on the approval of your application lies solely with the respective Spanish authority. ¡TODO! Mallorca cannot guarantee the issuance of a tax number, residence permit, or any other official approval.
We reserve the right to fully or partially assign your order to a third party. We also reserve the right to reject applications. In such cases, we will inform you accordingly. Your order is accepted either by sending a separate order confirmation email or by providing the required forms within two days.
3. Payment
We begin working for you after receipt of a down payment. When applying for the combined Residencia and NIE number service, a down payment of EUR 69.00 may be required. In this case, the down payment is non-refundable. The remaining balance is payable only after the service has been rendered.
Before handing over your NIE number or any other completed service, full payment must be received. The following payment methods are available:
Bank transfer:
We will provide our Spanish IBAN bank details in a separate email, allowing you to make a convenient bank transfer.
Cash payment upon collection:
You may pay the invoice amount in cash when collecting the documents.
PayPal:
We will send you the necessary payment information so that you can pay online.
3a. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal when concluding a contract for the provision of services.
Withdrawal Policy
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (¡TODO! Mallorca, email: info@todo-mallorca.es) of your decision to withdraw from this contract by means of a clear statement (e.g. by email).
To meet the withdrawal deadline, it is sufficient for you to send the notification concerning the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the date on which we received notification of your withdrawal.
Expiry of the Right of Withdrawal
Your right of withdrawal expires prematurely if we have begun performing the service after you have expressly agreed that we may commence performance before the expiry of the withdrawal period and you have simultaneously confirmed that you will lose your right of withdrawal upon full performance of the contract by us.
Consent to the early commencement of the service and confirmation of the expiry of the right of withdrawal shall be given by an explicit declaration by the customer, in particular by written consent via email or by payment following appropriate notice in the order confirmation or invoice.
4. Customer Cooperation Obligations
You undertake to provide any missing or incomplete documents and to cooperate in the processing of your application. If you fail to respond after repeated requests regarding incomplete forms, your documents will be returned via the most economical postal method.
¡TODO! Mallorca shall only be liable for loss or damage to documents during shipment in accordance with Sections 6 and 6.1 of these GTC.
5. Processing Times
We endeavor to process your order as quickly as possible. Responsibility for the timely submission of documents and forms lies solely with ¡TODO! Mallorca. However, delays cannot always be avoided.
Deadlines set by you will be observed where possible, but they are not legally binding. Decisions regarding the execution of the service (e.g. issuance of a NIE number or similar) are made exclusively by the competent Spanish authority, over which we have no influence.
If you have any questions, complaints, or objections, you may contact us by email at info@todo-mallorca.es.
6. Liability
We provide our services with due care and to the best of our knowledge. We do not guarantee the success of the applied-for services (e.g. issuance of a NIE number, residence permit, or other official decisions), as these lie exclusively within the responsibility of the competent Spanish authorities.
We shall be liable without limitation in cases of intent or gross negligence, as well as for injury to life, body, or health.
In cases of slight negligence involving the breach of essential contractual obligations (cardinal obligations), our liability shall be limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfillment is necessary for the proper performance of the contract and on whose compliance you may regularly rely.
Any further liability for slight negligence is excluded.
We assume no liability for information, deadlines, or delays caused by authorities, third parties, or incomplete or late submission of documents. The same applies to decisions made by Spanish authorities over which we have no influence.
6.1. Liability for Loss or Damage to Documents
If documents entrusted to us are lost or damaged while in our possession, our liability—except in cases of intent or gross negligence—shall be limited to a maximum amount of EUR 100 per client.
If completed documents are lost or damaged during postal delivery to the customer, our liability shall be limited to the compensation amount paid by the respective shipping service provider. Any further claims are excluded.
As a gesture of goodwill and without acknowledgment of a legal obligation, we may reimburse part of the replacement costs in individual cases, up to a maximum of EUR 100.
7. Jurisdiction
The law of the Kingdom of Spain shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a business entity within the meaning of applicable law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship shall be Palma de Mallorca, Spain.
For consumers, the statutory places of jurisdiction shall apply.
8. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at
https://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
9. Final Provision
Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
